INTENDMENT of Crimes; this, in case of treason, where the intention is proved by circumstances, is punishable in the same manner as if it was put in execution. So, if a person enter a house in the night-time, with an intent to commit burglary, it is felony; also, an assault, with an intent to commit a robbery on the highway is made felony, and punished with transportation, 7 Geo.
