CUSTOM (Fr. coutume, for constume), in a legal sense, is applied to such acts or practices as through time have passed into established use, and thus obtained a legal force. Custom is hence defined, both by lawyers and civilians, as lex non scripta, a law not written, established by long usage and the common consent; in which sense it stands opposed to the lex scripta, or written law.
