Scots law, signifies either that care and attention which parties are bound to give, in implementing certain contracts or trusts, and which varies according to the nature of the contract; as to which, see Scots Law, title 7. 20. and 28.: Or it signifies certain forms of law, whereby the creditor endeavours to operate his payment, either by affecting the person or estate of the debtor; see tide 18.
