in a shipmaster, is his cheating the owners. If goods delivered on ship-board are embezzled, all the mariners ought to contribute to the satisfaction of the party that lost his goods, by the maritime law; and the cause is to be tried in the admiralty. In a case where a ship was infested against the bartraty of the master, &c. and the jury found that the ship was lost by the fraud and negligence of the master, the court agreed, that the fraud was bartraty, though not named in the covenant; but that negligence was not.
