When parties in a suit are allowed a proof of allegiances; after the time limited by the judge for taking the proof is elapsed, either party may apply for circumduction of the time of proving; the effect of which is, that no proof can afterwards be brought, and the cause must be determined as it stood when circumduction was obtained.
