BARRATRY, in a shipmaster, is his cheating the
owners. If goods delivered on ship-board are em-
bezzled, all the mariners ought to contribute to the
satisfaction of the party that lost his goods, by the
maritime law; and the cause is to be tried in the ad-
miralty. In a case where a ship was injured against the
barretry of the master, &c. and the jury found that
the ship was lost by the fraud and negligence of the
master, the court agreed, that the fraud was barretry,
though not named in the covenant; but that negli-
gence was not.
