This form of proceeding was very frequent, not only in criminal but in civil causes; being built on a supposition that God would never grant the victory but to him who had the best right. The last trial of this kind in England was between Donald lord Ray appellant, and David Ramsay, Esq; defendant, when, after many formalities, the matter was referred to the King's pleasure.
